Delivery, Returns and Refunds We want buying from Gusto to be straightforward. This policy explains delivery, change-of-mind returns, faulty goods and refunds. It applies alongside our Terms and Conditions and does not reduce any statutory rights. 1. Delivery area We currently accept delivery addresses within Great Britain that are supported by our checkout and carriers. We do not currently offer general delivery to Northern Ireland or overseas unless we agree it in writing before the order is placed. 2. Delivery charges FREE STANDARD DELIVERY APPLIES ONLY TO ELIGIBLE GUSTO-BRANDED HAND TOOLS. It does not apply to tool storage, tool chests, cabinets, carts, trolleys or other bulky storage products. Tool-storage carriage will be charged separately and the amount will be shown at checkout or agreed with you before payment. 3. Dispatch and delivery times We aim to dispatch orders promptly. The estimated delivery period will be shown at checkout, in the order confirmation or communicated separately for bulky goods. Unless a different period is agreed, consumer orders will be delivered without undue delay and within 30 days after the contract is made. Delivery estimates may be affected by weekends, public holidays, stock availability, carrier disruption, weather and remote locations. We will contact you if we become aware of a material delay. 4. Bulky deliveries Tool carts, cabinets and other bulky goods may require a suitable access route, a firm and level unloading area and somebody present to accept delivery. Please tell us before ordering about steps, restricted access, gravel, soft ground, narrow entrances or any other issue that may affect safe delivery. Carriage normally covers delivery only and does not include unpacking, assembly or movement to an internal location unless expressly agreed. 5. Checking a delivery Please check the packaging and goods as soon as reasonably possible. If a parcel appears seriously damaged, note this with the carrier where possible and contact us promptly with photographs. Signing for a parcel does not remove any statutory rights. If an item is missing, incorrect or damaged, email hello@gustotool.co with your order number and photographs where relevant. 6. Change-of-mind cancellation rights If you are a consumer buying online, you normally have the legal right to cancel most orders without giving a reason. You must tell us that you wish to cancel within 14 days beginning the day after you receive the goods. After telling us, you normally have a further 14 days to send the goods back. In addition to those legal rights, Gusto offers a voluntary 30-day return promise for eligible unused goods. To use the voluntary promise, the goods must be sent back so that we receive them within 30 days after delivery, unless we agree otherwise. 7. How to cancel or arrange a return Email hello@gustotool.co before sending anything. Include your name, order number, the item being returned and whether it is a change-of-mind return, a fault, damage or an incorrect item. We will provide the current return instructions and address. A clear statement is sufficient. You may use the following wording: “I give notice that I cancel my contract for the sale of [product], ordered on [date] and received on [date]. My name is [name], my address is [address], and my order number is [number].” 8. Condition of change-of-mind returns You may inspect goods in the same way that you reasonably could in a shop. Please return them complete, secure, clean and, where reasonably possible, with their original packaging, accessories, instructions and proof of purchase. We may make a lawful deduction from the refund where handling has reduced the value of the goods beyond what was necessary to establish their nature, characteristics and function. The voluntary 30-day promise may be refused where goods are used, damaged, incomplete, modified or not reasonably capable of resale, but this does not remove statutory rights. 9. Return costs For a change-of-mind return, you are responsible for the direct cost and safe carriage of returning the goods unless we have agreed otherwise. Use a tracked and suitably insured service and keep evidence of dispatch. Bulky products may be expensive to return and must be transported by a suitable carrier. Contact us before arranging carriage. Where goods are faulty, damaged in transit or supplied incorrectly, we will provide or reimburse a reasonable return method where a return is required and agreed with us. 10. Refunds for change-of-mind cancellations Where the legal cancellation right applies, we will refund the price paid and the cost of the least expensive standard delivery option offered by us. Any extra amount paid for enhanced or expedited delivery is not refundable unless the service was not provided. We may withhold the refund until we receive the goods or you provide evidence that they have been sent back, whichever occurs first. The refund will be made within 14 days after that point, using the original payment method unless otherwise agreed. 11. Faulty, not-as-described or unfit goods Consumer goods must be of satisfactory quality, fit for purpose and as described. If a fault is present, your remedy depends on the circumstances and timing. Consumer law may provide a short-term right to reject within 30 days, followed in appropriate cases by rights to repair or replacement and, if those remedies fail or are unavailable, a price reduction or final right to reject. Contact us as soon as possible with the order number and details of the problem. Do not continue using a tool if doing so may be unsafe or worsen the damage. 12. Exceptions Legal change-of-mind cancellation rights do not apply to every type of goods. Exceptions may include goods made to your specification or clearly personalised, sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed, and other categories excluded by law. Faulty-goods rights are not affected. 13. Orders returned by the carrier If an order is returned because an address was incorrect, delivery was refused or reasonable delivery attempts failed, we will contact you. We may deduct or request reasonable additional carriage costs where the failure was not caused by us or the carrier and where the law allows. 14. Information we may collect We may collect and use the following types of personal information: •your name, billing address, delivery address, email address and telephone number; •details of orders, payments, deliveries, returns, refunds and warranty claims; •messages, enquiries, reviews, competition entries and other communications you send to us; •account details and preferences where you create or use a website account; •marketing preferences and information about how you respond to our emails or promotions; •technical information such as IP address, browser type, device information and website usage data; and •information needed to prevent fraud, protect our business or comply with legal obligations. Payments are processed by the payment providers offered at checkout. We do not normally receive or store your full payment-card details. 2. How we collect information We collect information directly from you when you place an order, complete a contact form, email or telephone us, create an account, join a mailing list, enter a promotion, submit a review or make a return or warranty claim. We may also receive information from our website provider, payment providers, delivery companies, social-media platforms and other service providers involved in your transaction or interaction with us. 3. Why we use your information We may use personal information to: •take payment, accept and fulfil orders and provide order confirmations; •deliver goods and provide delivery updates; •respond to enquiries and provide customer service; •manage cancellations, returns, refunds, complaints and warranty claims; •maintain financial, tax, company and business records; •protect customers and our business against fraud, misuse and security threats; •improve our products, website, customer experience and business operations; •send marketing where you have agreed to receive it, or where the law otherwise permits; and •establish, exercise or defend legal claims and comply with lawful requests from public authorities. 4. Our lawful bases UK data protection law requires us to have a lawful basis for using personal information. Depending on the purpose, we rely on one or more of the following: •Contract — where the information is needed to process an order or take steps requested by you before a purchase. •Legal obligation — where we must keep records or disclose information to comply with law, tax or regulatory duties. •Legitimate interests — where reasonably necessary to operate and improve the business, prevent fraud, protect our rights, answer enquiries and understand how our website is used, provided those interests are not overridden by your rights. •Consent — for optional marketing or non-essential cookies where consent is required. You may withdraw consent at any time. 5. Who we share information with We only share personal information where reasonably necessary. Recipients may include Wix and other website or IT service providers, payment providers, banks, couriers and fulfilment providers, email and marketing suppliers, accountants, insurers, legal advisers, fraud-prevention services, HM Revenue & Customs, regulators, courts and law-enforcement bodies. We do not sell your personal information. Service providers are permitted to use information only for the relevant service or as otherwise allowed by law. 6. International transfers Some service providers may process information outside the United Kingdom. Where this happens, we take reasonable steps to ensure that an appropriate legal safeguard is used, such as an adequacy regulation, approved contractual protections or another lawful transfer mechanism. 7. How long we keep information We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, accounting, tax, warranty and dispute-resolution requirements. Transaction and accounting records are normally retained for at least six years where required. Marketing information is kept until you unsubscribe, withdraw consent or we decide it is no longer needed. 8. Security We use reasonable organisational and technical measures intended to protect personal information against loss, misuse, unauthorised access, alteration or disclosure. No internet or storage system can be guaranteed to be completely secure. 9. Your rights Depending on the circumstances, you may have the right to: •ask for a copy of your personal information; •ask us to correct inaccurate or incomplete information; •ask us to delete information in certain circumstances; •ask us to restrict how information is used; •object to certain uses, including direct marketing; •receive certain information in a portable format; and •withdraw consent where we rely on consent. You may unsubscribe from marketing at any time by using the link in an email or contacting us. 10. Complaints Please contact us first so that we can try to resolve any concern. You also have the right to complain to the Information Commissioner’s Office, the United Kingdom’s data-protection regulator. 11. Children Our website and products are not directed at children, and we do not knowingly collect personal information from children. 12. Changes to this policy We may update this policy when our services, suppliers or legal obligations change. The latest version will be published on this page with an updated date. Hand-Tool Lifetime Guarantee and Tool-Storage 12-Month Warranty IMPORTANT: THE LIFETIME GUARANTEE APPLIES ONLY TO ELIGIBLE GUSTO-BRANDED HAND TOOLS. IT DOES NOT APPLY TO TOOL STORAGE. 1. Lifetime guarantee: eligible hand tools only THE NO-QUIBBLE LIFETIME GUARANTEE APPLIES ONLY TO A GENUINE GUSTO-BRANDED HAND TOOL whose product page, packaging or written sales information expressly states that it carries the guarantee. Tool storage is not included. It covers a functional failure caused by defective materials or workmanship during the usable working life of the tool, when the tool has been used normally and for its intended purpose. 2. Tool storage: 12-month warranty TOOL STORAGE IS NOT COVERED BY THE LIFETIME GUARANTEE. Gusto tool-storage products, including tool chests, cabinets, carts, trolleys and related storage items, are covered instead by a 12-month warranty from the date of delivery against defects in materials and workmanship under normal use. The 12-month tool-storage warranty does not cover normal wear and tear, cosmetic damage, overloading, misuse, accidental damage, corrosion, unauthorised modification, or damage caused by unsuitable handling, assembly, installation, storage or transport. This warranty is provided in addition to statutory rights. 3. What we will do After assessing the claim, we will normally repair the tool, replace the affected tool or component, or provide an equivalent replacement where the original model is no longer available. The appropriate remedy is chosen by Gusto, acting reasonably. Where stock and delivery services allow, we aim to deal with accepted claims promptly. Dispatch and delivery times are targets, not guarantees. 4. What is not covered by either warranty Neither the lifetime hand-tool guarantee nor the 12-month tool-storage warranty covers: •normal wear and tear or the expected wearing out of a product through use; •cosmetic marks, scratches, discolouration or damage that does not affect safe function; •rust or corrosion caused by damp storage, chemicals, neglect or inadequate care; •misuse, abuse, overloading, accidental damage, loss, theft or deliberate damage; •use of the wrong size or type of tool, unauthorised extensions, excessive leverage or use contrary to accepted workshop practice; •striking, impact or power-tool use where the product is not designed for it; •alteration, grinding, welding, drilling, unauthorised repair or modification; •damage caused by a third-party product, fastener, machine, vehicle or external event; •consumables, packaging, EVA foam trays and removable cases unless their product page expressly states otherwise; or •products bought from an unauthorised seller where genuine supply or purchase cannot reasonably be verified. 5. Making a claim Email hello@gustotool.co with your name, contact details, order number or other reasonable proof of purchase, the product description and clear photographs or a short video showing the problem. Please explain how the failure occurred. We may ask for further information or require the product to be returned for inspection. Do not send a product until return instructions have been provided. If a return is reasonably required and the claim is accepted, we will provide a suitable return method or reimburse reasonable standard return postage where agreed in advance. 6. Replacement products A replacement may be new or serviceable replacement stock and may differ in colour, finish, packaging or minor specification, provided it offers substantially equivalent function. A replacement eligible hand tool continues to be covered for the remaining usable life of that hand tool under these terms. A repaired or replacement tool-storage product is covered only for the unexpired part of the original 12-month warranty period. 7. Warranty periods For an eligible hand tool, “lifetime” means the usable working life of that hand tool. It does not mean that a product can never wear out, and it does not cover normal deterioration caused by repeated use. THE LIFETIME PERIOD NEVER APPLIES TO TOOL STORAGE. THE TOOL-STORAGE WARRANTY LASTS 12 MONTHS FROM THE DATE OF DELIVERY. 8. Statutory rights This guarantee is provided in addition to your legal rights. It does not restrict any rights or remedies available under applicable consumer law, including rights relating to goods that are faulty, not as described or not fit for purpose. 9. Administration The guarantee has no cash value and cannot be used to obtain an upgrade or refund after the applicable legal or voluntary return period unless the law requires otherwise. We may refuse fraudulent, abusive or unsupported claims. Terms and Conditions These terms apply to purchases made through the Gusto Tool Co website. Please read them before ordering. Nothing in these terms limits rights that cannot lawfully be excluded. 1. Who may order You must be at least 18 years old and legally capable of entering into a contract. By ordering, you confirm that the information you provide is accurate and that you are authorised to use the chosen payment method. If you buy wholly or mainly for business purposes, some statutory consumer rights, including change-of-mind cancellation rights, may not apply. Any rights that the law gives you as a consumer remain unaffected. 3. Products and descriptions We take reasonable care to describe and display products accurately. Colours, finishes and scale may vary slightly from how they appear on a screen. Measurements and weights are approximate unless stated otherwise. Packaging and minor product details may change where this does not materially affect performance or quality. Product photographs, demonstrations and workshop or motorsport content are illustrative. You are responsible for checking that a product is suitable for your intended task, drive size, fastener, load and working environment. 4. Orders and contract formation Placing an order is an offer to buy. An automated acknowledgement confirms that we have received the order but does not necessarily mean it has been accepted. A binding contract is formed when we send an acceptance or dispatch confirmation, or when we dispatch the goods, whichever occurs first. We may decline or cancel an order before dispatch if, for example, stock is unavailable, a price or description is clearly wrong, payment is not authorised, delivery is not possible, fraud is suspected or an order breaches a purchase restriction. If payment has been taken, it will be refunded. 5. Prices, VAT and carriage Prices are shown in pounds sterling and include VAT unless clearly stated otherwise. The price payable is the price shown when the order is placed, subject to correction of an obvious error. FREE STANDARD DELIVERY WITHIN OUR STATED DELIVERY AREA APPLIES ONLY TO ELIGIBLE GUSTO-BRANDED HAND TOOLS. It does not apply to tool storage, tool chests, cabinets, carts, trolleys or other bulky storage products. Those products will have a separate carriage charge, shown at checkout or agreed before payment. Any optional or enhanced delivery charge will also be shown before payment. 6. Payment Payment must be made using a method offered at checkout. Payment services may be provided by third parties such as card processors, PayPal or finance providers. Their separate terms may apply. We are not responsible for a payment provider’s decision to approve, decline or delay a transaction. Where instalment or credit facilities are offered by a third party, the credit agreement is between you and that provider. Refunds will be processed through the original payment route. 7. Delivery We currently deliver only to addresses we accept within Great Britain unless we agree otherwise in writing. The available delivery options and any charge will be shown at checkout or agreed before dispatch. We will provide an estimated delivery period. Dates are estimates unless we expressly agree a guaranteed date. Unless a different period is agreed, consumer orders will be delivered without undue delay and within 30 days after the contract is made. You are responsible for giving a complete and accurate delivery address and for ensuring that somebody can accept bulky deliveries where necessary. Additional costs caused by an incorrect address, refusal of delivery or repeated failed delivery may be charged where lawful. 8. Risk and ownership For consumers, responsibility for loss or damage normally passes to you when the goods are delivered to you or to a person identified by you. Ownership passes when we have received payment in full and the goods have been delivered. 9. Cancellation and change-of-mind returns Consumers buying online normally have a legal right to cancel most goods without giving a reason. Our Delivery, Returns and Refunds policy explains the procedure and our additional 30-day return promise. Certain legal exceptions may apply, including to goods made to a customer’s specification or clearly personalised. 10. Faulty, damaged or incorrect goods Goods must be as described, fit for purpose and of satisfactory quality where consumer law applies. Contact us promptly if goods arrive damaged, are incorrect or develop a fault. Depending on the circumstances and the law, you may be entitled to a refund, repair or replacement. Our voluntary guarantee is additional to, and does not replace, statutory rights. 11. Product warranties THE NO-QUIBBLE LIFETIME GUARANTEE APPLIES ONLY TO ELIGIBLE GUSTO-BRANDED HAND TOOLS AND DOES NOT APPLY TO TOOL STORAGE. Tool storage products are covered instead by a 12-month warranty from the date of delivery against defects in materials and workmanship, subject to the exclusions in the separate warranty policy. The lifetime guarantee applies only where the product page, packaging or written sales information expressly says that the hand tool is covered. 12. Safe and proper use Tools must be used only for their intended purpose, by a competent person, with suitable personal protective equipment and in accordance with accepted workshop practice. Do not use damaged, modified or incorrectly sized tools. Do not exceed a tool’s intended loading, use unauthorised extensions or strike a tool unless it is specifically designed for impact or striking use. You remain responsible for selecting and using tools safely. This clause does not exclude liability that cannot lawfully be excluded. 13. Promotions and discount codes Promotions and discount codes are subject to their stated terms, availability and closing date. Unless stated otherwise, codes cannot be combined, exchanged for cash or applied retrospectively. We may withdraw or correct a promotion affected by an obvious error, fraud or misuse. 14. Our responsibility We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot be excluded. For consumers, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, for business losses suffered by a consumer, or for loss caused by misuse, unauthorised modification, failure to follow instructions or use of an unsuitable product. Where you purchase wholly or mainly for business purposes, our liability is subject to any separate written business terms agreed with you and to the maximum extent permitted by law. 15. Events outside our reasonable control We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect and keep you informed. If a significant delay occurs, you may have a right to cancel and receive a refund for goods not supplied. 16. Personal information We use personal information as described in our Privacy Policy and Cookie Notice. 17. Changes to these terms The terms in force when an order is placed will apply to that order. We may change these terms for future orders to reflect changes to the business, website, products or law. 18. If part of these terms is invalid Each paragraph operates separately. If a court or authority finds one part unlawful or unenforceable, the remaining parts will continue in effect. 19. Governing law These terms are governed by the law of England and Wales. Consumers may bring proceedings in the courts of the part of the United Kingdom in which they live where applicable. Nothing in this clause removes any mandatory protection available to you. 20.
